第1页共8页装饰工程合同ContractofConstructionProject合同编号ContractNumber工程名称ProjectName发包方甲方EmployerPartyA承包方乙方ContractorPartyB根据中华人民共和国合同法和建筑安装工程承包合同条例及有关规定为明确双方在施工过程中的权利义务和经济责任经双方协商同意签订本合同InordertomakedefiniteoftherightsobligationsandeconomicresponsibilitiesofbothpartiesduringtheconstructionthepartiesinaccordancewithThePRCContractLawandConstructionEngineeringContractRegulationsandrelevantprovisionsagreetosignthiscontract第一条工程项目Article1Projectitem工程地点Projectsite2工程范围Scopeofproject3工程造价人民币元整该造价为包工包料价ProjectcostPMBYuanonlyCostofthiscontractisthecontractpriceforlaborandmaterials第2页共8页第二条施工准备Article2Preparationforconstruction甲方协助乙方办理临时水电及垂直运输提供建筑图纸及有关隐蔽障碍物的资料PartyAshallassistspartyBtodealwiththeproceduresoftemporaryhydropowerandverticaltransportationandprovidearchitecturaldrawingsanddocumentsofrelevantconcealedobstacles乙方PartyB负责施工区域的临时设施水电管线的铺设管理使用和维修工作Beresponsiblefortheworksoflayingmanagementuseandmaintenanceofthetemporaryfacilitieswaterandelectricitypipelineintheconstructionarea组织施工管理人员和材料施工机械进场OrganizeconstructionmanagementstaffandconstructionmaterialsconstructionmachineryentertheSite负责在装修期间保持公共地方清洁及每天负责将装物料弃置于由管理处指定的垃圾收集处Beresponsibleforkeepingpublicplacescleanduringconstructionandpackingconstructionmaterialandleavinginthegarbagecollectionplacedesignatedbymanagementofficeeachday第三条工程期限Article3PeriodofConstruction1根据工期和使用需要商定工程总施工期为天日历天自年月日开工至年月日完工AccordingtotheperiodofconstructionandtheuseneedthetotalconstructionperiodagreedshallbedaysCalendardaysstartfromthedateofandcompleteonthedateof如遇下列情况经甲方现场代表签证后工期相应顺延ConstructionperiodshallbeprolongeduponPartyAsiterepresentativesconfirmationwhenthemattersoccurasfollows第3页共8页按施工准备规定甲方未协助乙方办理临时水电及垂直运输影响进场施工AccordingtotherequirementsofconstructionpreparationPartyAfailtotassistPartyBtoapplyfortemporarywaterandelectricityandverticaltransportationandhaveanimpactonPartyBconstruction因甲方提出增减项目而造成重大设计变更因而影响进度ThematerialmodificationorchangeofdesignduetothepartyAsrequirementofadditionordeletionofprojecthavetheeffectofhindranceontheprogressofworks未按合同规定拨付预付款工程款而影响施工PartyAfailtopaytheadvancepaymentandconstructioncosttopartyBandimpacttheconstructionprogress人力不可抗拒的因素而延误工期ThedelayofscheduleofconstructionduetoForceMajeure第四条工程质量Article4Thequalityofproject一本工程质量经双方研究要求达到双方约定之验收标准Thequalityofprojectshouldachievetherequirementsofacceptanceagreedbybothparties二乙方必须严格按照施工图纸说明文件和国家颁发的建筑工程规范规程和标准进行施工并接受甲方的监督PartyBshouldcarryontheconstructioninstrictaccordancewithdrawingspecificationfileandregulationsandspecificationsauthorizedbythecompetentauthoritiesandbeunderthesupervisionofPartyA三乙方在施工过程中必须遵守下列规定PartyBshouldduringtheconstructioncomplywiththeprovisionsasfollows由乙方提供给甲方的所有材料必须经甲方同意方可使用未按要求购买严禁使用AllmaterialsprovidedbyPartyBshouldbesubjecttotheapprovalofPartyA第4页共8页priortouseAndnoneofthesamebeingboughtwithoutconformitywithPartyArequirementscanbeused隐蔽工程必须经甲乙双方检查方可进行下一道工序Theconcealedworksshouldbecheckedbybothpartiesbeforethenextprogress工程竣工后乙方按规定对工程实行保修保修时间自通过竣工验收之日算起保修期一年PartyBshalltaketheliabilityofmaintenancefollowingthecompleteofworksTheperiodofmaintenanceshallbeoneyearfromthedayofacceptanceofcomplete第五条工程价款的支付与结算Article5Paymentandsettlementofthecontractprice合同总价50即元Thetotalcontractprice50whichisYuan中期款Thepaymentofmediumterm工程进度过半三日内Within3threedaysaftertheprogressmorethanhalf合同总价40即元Thetotalcontractprice40whichisYuan尾款FinalPayment竣工验收结算后七日内Within7sevendaysafterthecompletionacceptanceandsettlement合同总价10即元Thetotalcontractprice10whichisYuan第六条施工与设计变更Article6TheModificationofConstructionandDesign第5页共8页一乙方交付的设计图纸说明和有关技术资料作为施工的有效依据开工前由甲方组织签字认同作为施工的补充依据甲乙双方均不得擅自修改DesigndrawingillustrationandrelevanttechnicaldataconsignedbypartyBarethebasisforconstructionandshallbeconfirmedbypartyAssignaturewhichisdeemedasthesupplementarybasisandshallbemodifiedbyanypartywithoutauthorization二施工中如发现因甲方要求而发生的设计错误或严重不合理的地方乙方应及时以书面形式通知甲方由甲方及时会同乙方等有关单位研究确定修改意见或变更设计文件乙方按修改或变更的设计文件进行施工若发生增加费用包括返工损失停工窝工人员和机构设备调迁材料构配件积压的实际损失由甲方负责并调整合同造价IfandwhenanyerrorormaterialunreasonableproblemofdesignduetopartyAsrequirementPartyBshallnotifyPartyApromptlyinwritinganddecidetheamendmentormodificationofthedesigndocumentationbytheconsultationandnegotiationbetweenpartiesandunitsconcernedPartyBshallcarryoutconstructionaccordingtothedesigndocumentsmodifiedorchangedIfprojectcostincreaseincludingtheactuallossofreworklossstoppageorslowdownpersonnelandmachineequipmentrelocatedmaterialstructuresfixturesbacklogshallberesponsibilitybyPartyAandbeadjustedthecontractpricetogetherwithPartyB三乙方在保证工程质量和不降低设计标准的前提下提出修改设计修改工艺的合理化建议经甲方设计单位或有关技术部门同意后采取实施AnyreasonablesuggestiononthemodificationsofdesignandcraftproposedbyPartyBsubjecttothequalityandwithoutreducingstandardsofdesigncouldbecarriedoutupontheapprovalofPartyAdesignunitorconcernedtechnicaldepartment四甲方如需设计变更必须作出正式修改通知书和修改图纸乙方才予实施重大修改和增加造价时必须另行协商乙方才予实施PartyAshouldifanynecessarydesignchangemaketheformalamendmentand第6页共8页modifydrawingsforPartyBsimplementationMaterialchangesandcostincreasedmustbenegotiatedbybothpartiesbeforePartyBimplementthesame第七条工程验收Article7Acceptanceofproject一工程施工中地下工程结构工程必须具有隐蔽验收签证试水抗渗等验收合格记录甲方须及时办理验收签订手续TheundergroundengineeringstructuralengineeringintheconstructionofprojectshouldbecheckedandwithissueofcertificateandtherecordofacceptanceofwatertestantipermeabilityandsoonPartyAshoulddealwiththeacceptancesignedformalitiestimely二工程竣工验收后甲方才可使用PartyAcanusetheprojectaftercompletionacceptance在规定的保修期内凡因施工造成的质量缺陷应由乙方无偿保修其保修条件范围和期限按城乡建设环境保护部84城建字第79号通知印发的建筑工程保修办法试行执行IntheprovisionwarrantyperiodanyconstructionqualitydefectsPartyBshouldmakemaintenancefreeofthequalitydefectduetoconstructionthescopeanddurationcarryoutaccordingtotheissuanceofChengJianNo79notificationConstructionengineeringguaranteemeasuresTrialbyUrbanandRuralConstructionandEnvironmentalProtectionDepartment84第八条违约责任Article8Liabilityforbreachofcontract乙方的责任ResponsibilityofPartyB一工程质量不符合合同规定的负责无偿修理和返工Takechargeofgratisrepairandreworkifprojectqualitydoesntmeetcontactsstipulation二工程不能按合同规定的工期交付使用的按合同中关于建设工期提交或拖后的奖罚规定偿第7页共8页付逾期罚款IffailtodelivertheconstructionaccordingtothecontractontimeTheoverduefinesaccordingtopunishmentorawardoftheprovisionconcerningthedeliveryordelay甲方的责任TheresponsibilityofPartyA一未能按照合同的规定履行自己应负的责任除竣工日期得以顺延外还应赔偿乙方由此造成的实际损失FailedtofulfilltheirresponsibilitiesinaccordancewiththeprovisionsofthecontractinadditiontothecompletiondatetobepostponedshouldbecompensationfortheactuallossofPartyB二工程中途停建缓建或由于设计变更以及设计错误造成的返工应采取措施弥补或减少损失同时赔偿乙方由此造成的停工窝工返工倒运人员和机械设备调迁材料和构件积压的实际损失TheongoingprojectisstoppedpostponedorduetodesignchangesandreworkcausedbydesignerrorsshouldtakemeasurestoremedyorreducelossesAtthesametimecompensatePartyBtheactuallossofworkstoppageslowdownredispatchreworkreshipmentstaffandmechanicalequipmentrelocatingthebacklogofmaterialsandcomponents第九条纠纷解决办法Article9Disputesettlement任何一方违反合同规定双方协商不成均可向北京仲裁委员会申请仲裁EitherpartycouldifanypartysbreachandfailtonegotiationsubmittheapplicationofarbitrationtotheBeijingArbitrationCommittee第十条附则Article10Supplementary第8页共8页一本合同一式贰份甲乙双方各执正本一份Thiscontractisexecuteintwocounterpartseachpartyholdsasingleoriginal二本合同自双方代表签字加盖双方公章或合同专用章即生效工程竣工验收符合要求待保修期满后合同终止ThecontractbecomeseffectiveaftersigningandsealingbybothpartiesonthisforegoingdateTheprojectfinalacceptancemeettherequirementsaftertheexpiryofwarrantyendsthecontract以下无正文Thereisnotextfollowing甲方盖章PartyAseal乙方盖章PartyBseal委托代理人签章Agent委托代理人签章Agent电话Tel电话Tel日期Date日期Date
