District. and the fixtures, fittings and equipment therein in cleaned and tenantable conditions to Party B(Party A should clean and check the property before party B moves in. The fixtures shall be in functioning condition). The size of the property is square meter. 租赁用途: Purpose of Lease: 乙方向甲方承诺,租赁该房屋作为 居住 使用,并遵守国家和本市有关房屋使用和物业管理的规定。 Party B warrants that the Property shall be used only for Living purposes. Party B also warrants that it will abide by the regulations of national and municipal laws of property leasing and management. 乙方保证,在租赁期内未征得甲方书面同意以及按规定须经有关部门审批而未核准前,不擅自改变上述约定的使用用途。 Party B promises that during the lease period, it shall not use the Property for any other purposes without Party A's prior written consent and the relevant government authority’s consent. 租期: Term of Tenancy: 甲乙双方约定,甲方于 年 月 日向乙方交付该房屋。【出租】房屋租赁期 固定,自 年 月 日起至 年 月 日止。 Both Party A and Party B agree that Party A will consign the Property to Party B on , and the leasing period is 1 fixed. The leasing period is from to . 在租期开始前,出租房屋及其家具电器应已装修或安装布置完毕,处于可供租赁的良好状态,并且甲方同意乙方在租期开始 日前将家具或物品搬入该房屋,乙方无需为此支付额外房租或费用。如果甲方在租期开始日没有向承租人交付符合使用状态的房屋及/或家具、电器,甲方应向乙方支付每日罚金,相当于月租金的三十分之一。该罚金将由甲方向乙方按日支付直至房屋及/或家具、电器完全交付至承租人为止。 The Leasing Premises and its equipment and furniture shall be fully renovated or installed and in tenantable condition before the commencement of the lease. Party A agrees that Party B may move all its furniture into the property days prior to the commencement of the lease term at no additional rent or cost of Party B. In the event that Party A does not hand over Premises, and /or furniture and electrical appliances to Party B in the required state on the Commencement Date, then Party A shall pay to Party B a daily penalty amounting to 1/30 of the monthly Rent, and which penalty shall be payable by Party A to Party B each day until the Premises, and /or furniture and electrical appliances are handed over to Party B. 租期届满,甲方有权收回出租房屋及全部家具、电器(包括附件所列之所有家具、设备),乙方亦应如期交还;乙方如要求续租,则享有优先续租权,但必须在本租约期满 30 日向甲方提出书面申请,租金双方另行协商。 On expiry of this lease term, Party A has the right to take back the leased property (including all the furniture, fittings and equipment listed in Appendix) in full, and Party B shall take back the leased property on time. If Party B wishes to renew the Leased Premise, Party B shall have the priority to renew the lease with a written notice 30 days in advance to Party A. In the event that Party B delays the payment of the Rental, Party B shall pay of the monthly Rental per day as a penalty for delay. 乙方支付租金的方式如下: 付款方式为:□付一押二 □付二押一 □其他: 付三押金一 乙方应于 前通过银行转账或现金方式向甲方支付第一笔租金及押金共计人民币 元。 The method of payment for the Rental of the Property shall be provided as following: Payment term: □Deposit of 2 months rental plus payment of rent every month. □Deposit of 1 months rental plus payment of rent every two months. □Other: deposit of 1month rental plus payment of rent every three months Party B should pay the first sum of rental and deposit RMB by bank transfer or in cash to Party A before . 押金其它费用: Deposit and Other Charges: 甲乙双方约定,乙方应向甲方支付房屋租赁押金,押金为 个月的租金,即人民币 元。甲方收取押金后向乙方开具押金收据。 Party B will pay an amount equivalent to month(s) Rental as deposit. The deposit is _ RMB. Party A shall provide a receipt to Party B upon receiving the deposit. 乙方如在租赁固定期内,因乙方原因而终止租约(不可抗力除外),应提前2个月通知甲方,否则押金不予退还。 If Party B terminates the Lease Agreement during the fixed lease term for reasons other than Force Majeure, Party B should inform Party A 2 months in advance, otherwise the deposit will be kept by Party A as penalty charge for breach of the contract from Party B. 甲方因乙方违反本合同的规定而受的损失,可在押金中扣抵合理数目,在甲方做出该种扣抵前,需书面通知乙方将被扣抵的金额和理由,乙方有权拒绝不合理或不公正的抵扣,押金扣除后不足部分乙方必须在接到甲方付款通知后 15 个工作日内补足。若以上情况发生在租赁期的最后两个月,甲方有权在租赁期结束前提出合理损坏赔偿,该赔偿金额双方确认。 Party A may deduct a reasonable amount from the deposit towards payment of any actual damages Party A may have incurred or suffered as a result of Party B's breach of this Agreement. Before making such deductions, Party A shall inform Party B with written notice of the amount which it intends to deduct and the reason for making such deductions. Party B shall be entitled to object to such deductions if they are unreasonable or unjustified. If the deposit is not sufficient, Party B must pay the deficiency when the deposit has been deducted within 15 working days after receiving the demand from Party A. If above situation happens in the last TWO months of the lease, Party A is entitled to raise demand for reasonable deduction, the amount shall be agreed by both parties. 押金以人民币支付,甲方收到押金后当日内,向乙方开具收据。 The deposit shall be paid in RMB. Party A shall issue a receipt to Party B the same day upon receiving the deposit. 甲方应于租赁关系消除且乙方迁空、点清并付清所有应付费用后的 3 日内将押金全额无息退还乙方。 Party A will return full amount of the deposit without interest in 3 days when this contract expires and party B clears the premises and has paid all due rental and other expenses. 若押金因乙方违约转为赔偿金,甲方应提供乙方相应金额的发票作为凭证。 If the deposit is kept by Party A as penalty charge due to breach of the contract from Party B, Party A should provide Party B duty-paid invoice in corresponding amount. 租赁期间,使用该房屋所发生 租赁期间的相关服务 由甲方承担; 等费用, 发票 均由乙方承担。 During the leasing period, relative rental service should be paid by Party A. invoice etc. should be paid by Party B. ? 甲方的权利和义务: Party A’s Rights and Obligations: 本租约签订后,甲方不得无故收回房屋,如甲方中途要求收回房屋,乙方有权拒绝。在征得乙方书面同意解除租约后,甲方应返还乙方已付押金及剩余租金,并且向乙方支付与押金相等的金额作为赔偿金。 Party A is not permitted to take back the leased property during the term of contract without any reason. If Party A wishes to do so, Party B has the right to refuse. Upon the written consent of Party B to terminate the Lease Contract, Party A shall return the deposit and prepaid rent to Party B and shall pay Party B the compensation of the same amount of the deposit. 甲方应保持房屋处于可居住的状态或者良好的使用状态。该状态是指(包括但不限于):所有电器工作状态及功能正常;任何情况,连续断电,断水,断煤气不超过48小时;管道及排水设施连续堵塞不超过72小时,如有以上发生情况,甲方会24小时派人过来查看,除非该堵塞是由于乙方故意所为。 Party A shall keep the good condition, and the leasing condition of the Premise including but not limited to mean:all electronic appliances work in order; at any circumstances, the interruption of water, gas and electricity shall not last over 48 hours; Pipe blockage shall not last over 72 hours, if problems occur, Party A shall allocate worker to come to check in 24hours , unless such blockage is caused by Party B’s deliberate conducts. 甲方应负责租赁期内房屋及其设备的正常维修,并承担维修房屋及设备的正常磨损而产生的费用。若乙方及其代理人通过租约注明的甲方联系方式无法通知到甲方及代理人,乙方有权自行安排修理。修理产生的合理费用由甲方承担,乙方有权从次月租金中扣除相应的费用,乙方应向甲方提供修理费用发票或收据。 Party A shall be responsible for all normal maintenance of leasing Premises and equipment during the lease term, and Party A shall undertake all maintenance cost. In the event that Party B or its agent couldn’t reach party A or its agent through the contact information listed in the Lease Agreement, Party B shall have the right to arrange the repair work itself, the service charge shall be undertaken by Party A;Party B shall have the right to deduct the service charge which is accordance with the figure on the invoice of the maintenance service from the next rental without Party A’s prior permission. 甲方应对其固定设施,包括该物业的或引入该物业的结构、屋顶、排污、管道和缆线(包括电力及电话)等进行维护,使之处于完好、可租赁状态。如果对上述各项的造成的损坏或破坏不是由乙方或乙方相关人员的不慎、疏忽或不良行为造成的,或在租赁期内因任何原因,包括但不限于停水、停电、漏水、漏气、空调、热水器不能正常工作,及其他造成房屋居住环境恶化,影响乙方指定住户的正常生活秩序的,则甲方在收到乙方发出的通知后48小时内迅速修理或修缮该损坏处。若2天内(电力、电话及宽带除外)甲方仍不能修缮或修缮无效,乙方有权停止支付租金直到上述情况改进至乙方合理满意为止或者提供乙方同等日租金的酒店,直至上述影响居住的情况改进至乙方合理满意为止。情况严重影响乙方正常居住的,乙方有权以书面形式通知甲方终止本租赁合同.甲方应将乙方已缴付的押金将如数归还乙方。 Party A should maintain and keep the leasing Premises’ fixtures, including but not limited to the structure, roof, sanitary and plumbing facilities, drains, pipes, cables, water stoppages, power outages, water or gas leaks and disruptions to air-conditioning supply in good leasing condition. In the lease term, the events including but not limited to, water, and power failures, leaks, leak, air-conditioning and water heater do not work for any reason, and other deterioration has affected the normal living of the occupant of the Premises designated by Party B, Party A should repair or remedy any defects within 48 hours after being notified of such defect by Party B, If Party A fails to improve the negative situation within two (2) days (except electricity, telephone and board band)after receiving of such demand, Party B shall be entitled to withhold Rent until rectification of the situation to be the reasonable satisfaction of Party B, or shall be provided the hotel which is charged the same as daily rental until rectification of the situation to be the reasonable satisfaction of Party B . If the events affect the normal living of the occupant of the Premises designated by Party B badly, Party B shall issue a written notice to Party A to terminate this Lease Agreement, and the security deposit paid by Party B shall be returned in full to Party B. 若甲方违反此租约的条款并在乙方发出书面通知15天后仍未改正,乙方有权终止此租约,收回押金,且有权进一向甲方要求索赔。 Party A covenants that Party B shall have the right to terminate the Lease Agreement when Party A seriously breaches the Lease Agreement and fails to remedy the breach after fifteen days of giving written notification of Party B, the Party B shall be entitled to withdraw the deposit without deduction and without prejudice to its right to claim for any losses and damages against Party A. 甲方保证如实、完整告知乙方关于租赁房屋权属、结构、环境及使用上的任何瑕疵和缺陷,如因甲方违反上述保证而造成乙方的任何损失,甲方应负责赔偿。 Party A guarantees it has made true and complete disclosure to Party B on the leasing Premises' title, structure, environment and any defects on its usage. Party A shall compensate Party B any losses incurred due to any breach of Party A to its above-mentioned guarantee. 甲方应提供证明其拥有租赁房屋的完整所有权或使用、出租权的相关证明并供乙方查验(包括但不限于土地使用权证书、房屋所有权证书、租赁合同、及其他证明文件)。 Party A shall provide documents to show its full ownership or right to hold or lease the property for Party B’s verification, those evidences including but not limited to the Land Use Right Certificate, House Ownership Certificate, Lease Contract and other supporting documents. 如在租赁期内,出租房屋发生所有权全部或部分的转移、或其他影响乙方权益的事情 时(甲方出售房屋或者抵押房屋),甲方应保证所有权人或其他影响乙方权益的第三者,能继续遵守本合同所有条款。纵使出租房屋已被转移,如乙方于本合同下的权益受此等所有权人或第三所影响或损害,甲方须负责补偿乙方的所有损失。 If during the lease term, all or part of the leasing Premises is transferred or mortgaged to a third party by Party A, or Party B's right to use the leased property is otherwise affected, Party A shall ensure that such transferee or third party having an effect on Party B's right to use the leasing Premises will continue to abide by the terms of this Lease Agreement. Even if the leased Premises is transferred where a transferee or a third party affects Party B’s interests under this Lease Agreement, Party A shall continue to be liable to keep Party B fully indemnified against all damages suffered by Party B. 甲方谨在此声明及保证甲方为出租房屋的合法拥有人并有合法地位出租此房屋于乙方。就本合同及出租此出租房屋予乙方之事,甲方已取得所有共同权利人及有关机构的批准,包括政府批准及/或抵押权人的同意(如适用)。甲方于本合同所做出的声明及保证,如有错误或违反者,甲方须就乙方因此而引致的任何损失、损害、支出及费用做出全部补偿。 Party A hereby represents and warrants that Party A is the legal owner of the leasing Premises and has the necessary legal capacity to lease the prop
